1. About the Service

Munchies Delivery ("we", "us", "our") operates a delivery platform connecting customers with local restaurants, supermarkets, and a point-to-point courier service in the Newcastle, NSW area.

By creating an account or placing an order through our website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the service.

2. Eligibility & Accounts

• You must be at least 18 years of age to create an account and place orders.
• You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility.
• You agree to provide accurate and current information during registration, including your name, email, phone number, and delivery address.
• We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Ordering & Menu Information

• Menu items, prices, and availability are provided by our partner restaurants and may change without notice.
• While we endeavour to display accurate information, we cannot guarantee that every item listed will be available at the time of your order.
• Special dietary requirements or allergen information should be confirmed directly with the restaurant. We are not liable for allergen-related incidents.
• Once an order is submitted and paid for, it is sent to the restaurant for preparation. Cancellations after payment may not always be possible.

4. Delivery

• Delivery is available within our service area in and around Newcastle, NSW. Addresses outside this area will not be accepted by our system.
• Delivery times shown at checkout are estimates only. Delays may occur due to traffic, weather, high demand, or restaurant preparation times.
• You must provide a valid delivery address and be available to receive your order at the scheduled time. If delivery cannot be completed due to an incorrect address or unavailability, a refund may not be issued.
• Our drivers will attempt to contact you by phone if they experience any difficulty locating you.
• Delivery time slots are subject to driver availability. If no drivers are available for your chosen time, you will be asked to select another slot.

5. Courier Service

• Our courier service allows you to request a driver to pick up an item from one address and deliver it to another within our service area.
• The courier fee is a flat rate per booking regardless of distance within our service area.
• We do not transport prohibited items including alcohol, tobacco, firearms, illegal substances, hazardous materials, or any items that are unlawful to possess or transport.
• Items must be ready for collection at the pick-up address at the scheduled time. If the item is not ready, the booking may be forfeited without refund.
• We accept no liability for the condition or value of items transported via the courier service. Items are transported at the owner's risk.

6. Pricing & Payment

• All prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.
• A delivery fee is added to each order and displayed at checkout before payment.
• Payment is processed securely through Stripe. We do not store your credit card details on our servers.
• By completing a payment, you authorise us to charge the total amount shown at checkout to your chosen payment method.
• If a payment fails or is declined, the order will not be processed.

7. Refunds & Disputes

• If you receive an incorrect order, missing items, or food substantially different from what was described, please contact us as soon as possible.
• Refund requests are assessed on a case-by-case basis. We may offer a full or partial refund depending on the circumstances.
• We are unable to offer refunds for orders that were delivered correctly but where the customer simply changed their mind.

8. Your Responsibilities

• Provide accurate delivery information including address and phone number.
• Be available to receive your delivery at the scheduled time.
• Treat our drivers, restaurant staff, and support team with respect. We have a zero-tolerance policy for abuse or threatening behaviour.
• Do not misuse the platform or attempt to gain unauthorised access to the service.

9. Privacy & Data

• We collect personal information necessary to provide our service, including your name, email, phone number, and delivery addresses.
• Your information is used solely to process and deliver your orders and improve our service.
• We do not sell, rent, or share your personal information with third parties for marketing purposes.
• Your data may be shared with our delivery drivers (limited to what is needed for your delivery) and our payment processor (Stripe).

10. Limitation of Liability

• Munchies Delivery acts as a platform connecting customers with restaurants and drivers. We are not the manufacturer or preparer of food items.
• To the maximum extent permitted by Australian Consumer Law, our liability for any claim is limited to the amount you paid for the specific order in question.
• Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded by law.

11. Service Availability

• Our service operates during the hours displayed on our home page. These hours may vary and are subject to change.
• We may temporarily suspend or restrict access to the service for maintenance or unforeseen circumstances.
• Individual restaurant availability is controlled by the restaurants themselves and may change at any time.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated date. Your continued use of the service after changes are posted constitutes your acceptance of the revised terms.

13. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes arising from the use of our service will be subject to the jurisdiction of the courts of New South Wales.
